How Late Can I Have an Abortion? Time Limits, Risks, and Free Help

Some states have no overall gestational limits on abortion and some have early or mid-pregnancy limits (up to 20 weeks). Some states have near-total or total abortion bans while others restrict abortion after fetal viability (~24–26 weeks) unless the pregnancy threatens the person’s life or health.  

Late-term abortions in most states are only legally available for serious medical reasons, but the exact legal allowances vary by state. While researching your state, it’s important to note that laws change often due to court rulings and legislation.   

How late can I take the abortion pill? 

The abortion pill (typically mifepristone + misoprostol) is much less effective after 10 weeks of pregnancy (counted from the first day of your last menstrual period). It’s important to understand the risks and side effects to a chemical abortion before taking the pill.   

Are surgical late-term abortions safe?  

As your pregnancy progresses, abortion procedures become more complex and carry higher risks (e.g., increased pain, longer recovery, greater likelihood of surgical intervention).  Late-term procedures (generally after ~20 weeks) are less common and typically only done for serious health reasons under medical supervision. 

What do I need to do before having an abortion? 

Many abortion providers require a diagnostic screening before performing the procedure, and it’s medically recommended to ensure the safest care. Regardless of how far along you are in your pregnancy, a diagnostic screening helps accurately determine: 

• Whether your pregnancy is viable (confirming presence of a heartbeat) 

• How far along your pregnancy is (gestational age) 

• Whether your pregnancy is intrauterine and healthy
